Terms and Conditions of Sale Applicable to the Cineve Streaming Service
These Terms and Conditions of Sale took effect from 1 August 2020.

The Cineve Streaming Service’s (hereinafter – Website) owner is the company Unlimited Media OÜ (hereinafter “Unlimited Media”), registry code: 11533544. located at Laki 14a, Tallinn

1. Validity of terms and conditions of sale, service and price information

1.1. The conditions of sale apply to purchases of services from the online Website www.cineve.eu.
1.2. The Service is an entertaining streaming service (Video-on-Demand), by means of which Unlimited Media makes accessible and digitally distributes films, TV shows, and other media content (hereinafter collectively and individually the “Content”) to individual users for personal use.
1.3. The prices of the services provided on the Website are indicated next to the content and include all taxes applicable to the subscriber. No additional charges to apply. All prices of services provided on the Website are in euros.
1.4. Information about Cineve contents is provided immediately adjacent to the content on the Website.

2. Placing an order

2.1. You can subscribe to the Service in 2 ways – on a pay-per-film basis (rent 1 film for 48 hours), or on a subscription basis (access the library titles for 7 or 30 days). Please note! The library does not include all the films available on the Cineve Website. This is mainly so because for some films, there is no licence for subscription video on demand (SVOD).
2.2. The films available on the Website are grouped under categories and you can find the price of the film next to the film description. Each film also has a label showing in what way it can be streamed (pay-per-film basis, library/subscription basis, or for free with ads).
2.3. The price of pay-per-film rental is shown right next to the relevant button, the prices of subscription based rentals can be found in the pop-up window, which appears at the time of subscription and allows you to choose the desired rental period.
2.4. The use of a chargeable Service requires registration on the Website. It is required to use your current e-mail address to register and also read and accept the General Terms and Conditions of Use and Privacy Policy.

3. Payment for Subscription

3.1. When placing an order, the required data fields should be filled in, including the subscriber’s confirmation the terms and conditions of use and sale and privacy policy are read and agreed. The total cost is then displayed on the screen. This can be paid securely via the following payment methods:
• Estonian bank links: Swedbank, SEB, Luminor, LHV, Coop Pank, Pocopay
• Latvian bank links: Citadele and Luminor
• Lithuanian bank links: SEB and Luminor
• Visa / MasterCard credit card payments
NB! When using a bank link payment confirm the order and then click on the ‘Return to merchant’ button.
3.2. Payment processing is provided by Maksekeskus AS. Unlimited Media as a responsible processor transfers the personal data necessary for the execution of payments to authorized processor Maksekeskus AS. Payment is charged in a secure environment of the payment service provider outside Cineve Website – paying with a bank link in the secure environment of the respective bank and paying with a credit card in the secure environment of Maksekeskus AS. Unlimited Media has no access to the subscriber’s bank and credit card details. The agreement enters into force when the amount payable is transferred to the bank account of the Website.
3.3. Unlimited Media, as the owner of the Website, is the responsible processor of the subscribers’ personal data and transfers the personal data necessary for making payments to the authorized processor Maksekeskus AS.

4. Shipment

4.1. The agreement will take effect and the film you have purchased will be ready for streaming immediately after Unlimited Media has received confirmation of successful payment on the Website, and payment confirmation appears on the screen of your device. This moment also marks the beginning of your streaming period. If the subscriber has provided an e-mail address when registering on the Website, an e-mail confirmation the availability of content will be sent.

5. Absence of the right of withdrawal

5.1. In compliance with the Law of Obligations Act §53, subsection 4, clause 7¹, you agree that after executing the payment for your subscription, you waive the right to withdraw from the agreement or to request a refund (apart from the cases set out in 6.2), considering that the Service provided through the Website is digital film streaming, which is not delivered to you on a tangible medium and is readily streamable for you.

6. Right to claim

6.1. The Website is responsible for the non-compliance of contents sold to a purchaser with the terms and conditions of the agreement or for deficiencies which already existed at the time of delivery and which occur within rental period. It is assumed that the defect was present at the time of delivery. It is the Website’s responsibility to prove otherwise.
6.2. If the Service is unavailable and this is caused by a fault of Unlimited Media, you will be entitled to compensation in proportion to the charge you have paid for the time during which the Service was unavailable. The price or part thereof shall be refunded no later than within 14 days of sending the respective request. Instead of monetary compensation, Unlimited Media may offer free access to the Service according to the time during which the Service was unavailable.
6.3. To gain compensation or free access, you must submit a relevant request within at least two months from the time during which the service was unavailable.
6.4. Without prejudice to the provisions of this clause, or to any other provisions contained in these Terms and Conditions of Sale, Unlimited Media will not accept responsibility for the non-availability of, or shortcomings in the Service if these are caused by the user, or are due to problems with internet connectivity or another condition beyond the control of Unlimited Media.
6.5. EXCEPT AS PROVIDED IN CLAUSE 6.2, UNLIMITED MEDIA (INCLUDING BUT NOT LIMITED TO ITS AFFILIATES AND SUBCONTRACTORS, EMPLOYEES, EXECUTIVES, AND OFFICERS) AND ITS LICENSORS WILL UNDER NO CIRCUMSTANCES ACCEPT RESPONSIBILITY FOR ANY INJURIES FROM SUSPENSION OF WORK, LOSS OR ERASURE OF DATA, LOSS OF PROFIT, OR THIRD PARTY CLAIMS, OR OTHER INDIRECT LOSSES.
6.6. The Website is not responsible for any deficiencies that have arisen after the content become available to the subscriber.
6.7. Unlimited Media cannot accept responsibility for a third party purchasing the Services, using your bank or credit card information without your knowing.
6.8. The online store will respond to the consumer ́s complaint in written form or in a form that enables written reproduction within 15 days.

7. Direct marketing and presonal information processing

7.1. The Website only uses the personal data entered by the subscriber for processing the order and providing the content to the subscriber.
7.2. The Website sends newsletters and offers to the subscriber’s e-mail address only if the subscriber has expressed their wish to receive them by entering their e-mail address on the Website and indicating their desire to receive direct mail.
7.3. The subscriber is able to opt-out of offers and newsletters sent to their e-mail address at any time by letting Unlimited Media know via e-mail or by following the instructions in an e-mail containing an offer.

8. Settlement of disputes

8.1. All complaints made by a subscriber about the Website must be e-mailed to address info[at]unlimitedmedia.ee.
8.2. If the subscriber and the Website are not able to settle the dispute by agreement, the subscriber may contact the Consumer Dispute Committee. The terms of the procedure can be viewed and the application submitted here. The Consumer Dispute Committee is competent to resolve disputes arising from an agreement between a subscriber and the Website. The resolution of disputes by the Consumer Dispute Committee is free of charge for the subscriber.
8.3. A purchaser may also turn to the dispute resolution bodies of the European Union.
